Welcome to the website of Float Shack LLC (“Float Shack,” “Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website and services, including paddle board rentals, inflatable kayak rentals, multi-person paddle board rentals, and Slate River Float Trips in Crested Butte, Colorado. By accessing this website or booking a reservation, you agree to be bound by these Terms.
1. Use of Website
You agree to use this website only for lawful purposes. You agree not to:
- Use the site for fraudulent bookings
- Attempt to interfere with website functionality
- Transmit malicious software
- Misrepresent identity or booking information
Float Shack reserves the right to restrict or terminate access at any time for violations of these Terms.
2. Reservations & Payments
All reservations require payment at the time of booking unless otherwise specified. By submitting a reservation, you:
- Represent that all booking information is accurate
- Authorize Float Shack to charge your payment method
- Agree to the applicable cancellation policy
Prices are subject to change without notice but will not affect confirmed bookings.
3. Cancellation Policy
All bookings are subject to our published Cancellation Policy. Key terms include:
- Full refund with 72+ hours notice
- Inside 72 hours: One (1) reschedule OR full-value gift card
- No shows / no call bookings are non-refundable and non-transferable
- No refunds due to weather or water flow; one reschedule or gift card allowed
4. Assumption of Risk & Liability Waiver
Participation in paddle boarding, kayaking, and river floating involves inherent risks including but not limited to:
- Drowning, collisions, river obstructions
- Changing water flows, wildlife encounters
- Weather exposure, equipment malfunction
All participants are required to sign a liability waiver prior to participation. By booking, you acknowledge:
- You understand and accept the inherent risks
- You assume full responsibility for your participation
- You release Float Shack LLC from liability to the fullest extent permitted under Colorado law
Failure to sign required waivers may result in cancellation without refund.
5. Equipment Responsibility
Customers are responsible for all rental equipment during the rental period. You agree to:
- Use equipment properly and safely
- Return equipment in the same condition provided
- Prevent damage caused by negligence or misuse
Optional equipment insurance may cover certain accidental damage. Lost or stolen equipment is not covered. Customers may be charged for missing or severely damaged items.
6. River & Water Conditions
River flow levels, weather, and water conditions may change rapidly in mountain environments. Float Shack LLC:
- Does not guarantee specific float times
- Does not guarantee specific water conditions
- May modify launch instructions for safety reasons
All decisions regarding safe operations are at the sole discretion of Float Shack crew.
7. Delivery & Shuttle Services
Delivery services are available to local Crested Butte accommodations only. Due to federal land regulations, Float Shack:
- Does not deliver to alpine lakes within the Gunnison National Forest
- Provides shuttle services only as described for the Slate River Float Trip
8. Gift Cards
- Gift cards do not expire
- Are stored within customer accounts
- Must be redeemed by contacting Float Shack directly
- Are non-refundable for cash value
9. Intellectual Property
All content on this website, including text, images, branding, logos, and design elements, is the property of Float Shack LLC and may not be copied, reproduced, or distributed without written permission.
10. Privacy
Use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Limitation of Liability
To the fullest extent permitted under Colorado law, Float Shack LLC shall not be liable for indirect, incidental, special, or consequential damages arising from:
- Use of rental equipment
- Participation in river or lake activities
- Website usage
- Booking or scheduling errors beyond our control
Total liability, if any, shall not exceed the amount paid for the reservation.
12. Governing Law
These Terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the appropriate courts located in Gunnison County, Colorado.
13. Modifications to Terms
Float Shack LLC reserves the right to update these Terms at any time. Continued use of the website or services constitutes acceptance of any revised Terms.
